Arkansas Targets VGW Over Alleged Illegal Online Casino Operations

Key Moments

  • Arkansas Attorney General Tim Griffin has initiated legal proceedings against VGW, claiming its platforms operate as unlicensed casinos.
  • The state alleges VGW’s brands enabled real-money gaming for Arkansas residents, generating $66m in taxable sales from July 2025 to June 2026.
  • VGW faces continued regulatory and legal scrutiny in several jurisdictions, following settlements and market withdrawals earlier this year.

State Action Against VGW

The Attorney General of Arkansas, Tim Griffin, has filed a lawsuit against VGW, the operator behind Chumba Casino, LuckyLand Casino, and Global Poker. The action, entered in White County Circuit Court on Wednesday (Nov 4), asserts that VGW runs illegal gambling businesses in Arkansas, challenging the company’s depiction of its products as sweepstakes-based rather than true gambling services.

Investigative Findings and Alleged Violations

According to the complaint, an inquiry by the Attorney General’s office concluded that Arkansas residents accessed casino-style games through VGW platforms, playing for opportunities to win cash prizes. Griffin insists that VGW’s business model fits the criteria set by Arkansas gambling statutes, regardless of the brand’s stated intentions. As he put it, “Companies that operate gambling businesses in Arkansas are subject to our gambling laws, plain and simple.”

Marketing Practices and Regulatory Concerns

The suit further emphasizes VGW’s promotional messaging, which frequently represented its offerings as lawful, safe, and social games. The filing cites references where users were assured game play was “100% safe and 100% legal,” and presented as entertainment rather than wagering. Additionally, VGW allowed participation by individuals as young as 18; in contrast, casinos regulated by the state require patrons to be at least 21. While VGW provided resources for responsible gaming, including self-exclusion and spending controls, the state argues these measures indicate an awareness of gambling risks.

Financial Stakes and Enforcement

According to court documents, VGW reported approximately $66m in taxable sales in Arkansas from July 2025 to June 2026, and remitted about $6m in sales and use taxes within that span. The lawsuit seeks civil penalties for alleged breaches of state consumer-protection law.

Continued Legal Challenges for VGW

VGW’s scrutiny is not confined to Arkansas. In September, Letitia James, New York’s Attorney General, reached an $8m settlement with VGW and its associated entities. This settlement covered penalties, disgorgement, and costs as part of a crackdown on unlicensed gambling operators.

Elsewhere, VGW has become involved in litigation in Florida, Louisiana, and Baltimore, at a time when the company is reducing its exposure in select markets. Earlier this year, VGW withdrew some brands from Canada, adding to its list of market exits.

Financial Performance and Leadership Changes

Despite these obstacles, the company’s overall revenue remains substantial, with reports indicating around $5bn in revenue prior to founder and former CEO Laurence Escalante taking the company private. Escalante departed in July, and interim CEO Mats Johnson now directs the firm. The company’s future approach and the response to mounting regulatory challenges await further developments under Johnson’s leadership.
