Under Section 5 (7) of the Interstate Treaty on Gambling 2021, Germany prohibits advertising for illegal gambling.

The GGL began proceedings in October of the previous year after identifying recurring illegal gambling advertisements linked to the rapper. Anyone who advertises illegal gambling must expect consistent official measures.” The regulator clarified that streaming participation in illegal gambling is considered advertising and said violations are actively pursued. Authorities also noted the challenge of enforcement in cases where individuals are difficult to locate, emphasizing that the GGL collaborates with police and utilizes all legal avenues.

The GGL’s focus remains on consumer protection, highlighting the risks associated with unlicensed gambling, including lack of state oversight, insufficient player safeguards, and significant dangers like addiction and financial harm. Officials stated, “The aim of the measures is to protect consumers from the risks of illegal gambling offers. These are not subject to state supervision, do not offer sufficient player protection and harbor considerable dangers such as addiction development and financial losses.”

Wider Trend Toward Influencer Regulation

Capital Bra’s case fits a broader international pattern. In September, the Dutch Kansspelautoriteit (KSA) fined influencers Stiefunspeelt, Turcos, and Buurtwachtt for promoting unlicensed gambling sites. Despite earlier warnings, the KSA noted continued violations and introduced escalating fines of €25,000 per infraction, with a cap of €75,000 for recurring content.

Similarly, in Finland, the National Police Board fined two influencers €30,000 each last September. One prohibition came into effect in June 2025, while the other is on hold pending appeal.

This enforcement trend has resulted in major legal actions, including a federal lawsuit filed in January in Virginia under the RICO statute.
